TERMS AND CONDITIONS OF ONLINE STORE
The owner of the online store www.sivan.ee (hereinafter referred to as the "online store") is TEMA GROUP OÜ (registration code 12598741), with its legal address at Ikaruse tee 61, Kohila vald, Rapla County, 79715.
Validity of the Sales Agreement, Product, and Price Information
The terms and conditions apply to the purchase of goods from the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. The price includes the cost of delivering the goods. All prices of the products sold in the online store are in euros.
The cost of delivery depends on the buyer's location and the method of delivery. The delivery cost is displayed to the buyer upon placing the order.
Product information is provided directly alongside the product in the Online Store.
Placing an Order
To place an order, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled in, and a suitable method of delivery must be chosen. The screen will then display the amount to be paid, which can be securely paid through the following payment methods:

NB! When making a payment via online banking, be sure to click the button "Back to the Merchant" on the bank's page.
Payments are processed by Paysera. Payment takes place outside the Online Store in a secure environment – payment through online banking is made in the secure environment of the respective bank, and payment by credit card is made in the secure environment of Paysera. The seller does not have access to the customer's bank or credit card details. The contract enters into force from the moment the payment amount is received in the Online Store's settlement account.
The owner of the online store is the data controller and transmits the necessary personal data for making payments to the authorized processor Paysera.
If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including the cost of delivery) will be refunded without delay but no later than within 14 days from the date of sending the notification.
Delivery
Goods are shipped to the following countries: Estonia.
The buyer has the following options for receiving the goods: Omniva, Itela Smart Post.
The buyer bears the shipping costs, and the corresponding price information is displayed next to the shipping method.
Deliveries within Estonia generally arrive at the buyer's designated destination within 7 working days from the entry into force of the sales agreement. Deliveries outside Estonia are made within 30 calendar days.
In exceptional cases, the right to deliver the goods extends to a maximum of 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in an online store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of withdrawal, the ordered goods must not be used in any way other than necessary to ascertain the nature, characteristics, and functioning of the goods, as would be permitted in a physical store for testing purposes.
If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, the online store has the right to reduce the refundable amount based on the decreased value of the goods.
To return the goods, a declaration of withdrawal from the purchase must be submitted, the form of which can be found here: [insert link to withdrawal declaration], and sent to the email address info@sivan.ee no later than 14 days after receiving the goods.
The buyer bears the cost of returning the goods unless the reason for the return is that the product does not conform to the ordered product (e.g., wrong or defective product).
The buyer must return the goods within 14 days after submitting the declaration of withdrawal or provide evidence that they have handed over the goods to the carrier within the aforementioned period.
Upon receiving the returned goods, the online store will refund all payments received from the buyer under the contract without delay, but no later than 14 days after receiving the declaration of withdrawal. The refund may be withheld until the online store has received the returned goods or until the buyer has provided evidence of returning the goods, depending on which occurs earlier.
If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the online store, the online store is not required to refund the additional cost exceeding the cost of the standard delivery method.
The online store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked down due to an error compared to the market price of the goods.
Right to submit a claim
The online store is responsible for non-conformity or defects in the goods sold to the buyer that existed at the time of delivery and which become apparent within two years from the delivery of the goods. Within the first year from the delivery of the goods, it is presumed that the defect existed at the time of delivery. It is the obligation of the online store to refute this presumption.
In the event of a defect becoming apparent, the buyer has the right to contact the online store within two months by sending an email to info@sivan.ee
The online store is not responsible for defects that occur after the goods have been handed over to the buyer.
If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will refund all fees associated with the sales contract to the buyer.
The online store will respond to consumer complaints in writing or in a form that allows written reproduction within 15 days.
Direct marketing and processing of personal data
The online store uses the personal data provided by the buyer solely for processing orders and delivering the goods to the buyer. The online store may transmit personal data to transport service providers for the purpose of delivering the goods.
The online store sends newsletters and offers to the buyer's email address only if the buyer has expressed their wish for it by providing their email address on the website and indicating their consent to receive direct marketing communications.
The buyer can unsubscribe from receiving offers and newsletters via email at any time by notifying us via email or by following the instructions provided in the email containing the offers.
Dispute resolution
If the buyer has any complaints regarding the online store, they should send them to the email address info@sivan.ee
If the buyer and the online store are unable to resolve the dispute through mutual agreement, the buyer has the option to turn to the Consumer Disputes Committee. The terms of the procedure and the possibility to submit an application can be found here [insert link]. The Consumer Disputes Committee is competent to settle disputes arising from the sales contract between the buyer and the online store. The examination of the buyer's complaint by the committee is free of charge.
The buyer may also submit a complaint to the European Union platform for online dispute resolution.
